Azerbaijan’s Top Court Bans Unauthorized Monitoring of Private Messaging

Azerbaijan’s Supreme Court has ruled that monitoring a person’s private correspondence, including messages sent via WhatsApp, without that person’s knowledge or consent is prohibited, according to a new legal position adopted by the court’s plenary session.

The ruling affirms that the right to privacy of correspondence protects the confidentiality of information transmitted through mail, telegraph, and other communication channels. Any unlawful acquisition, use, or dissemination of private messages without consent constitutes a violation of personal privacy rights.

The court noted that this right may be restricted only in cases предусмотренных законом, such as preventing a crime or establishing the truth during a criminal investigation.

It also clarified that parties to a legal dispute may submit only correspondence exchanged between themselves as evidence. Messages involving third parties cannot be used in resolving the dispute.

The decision further states that publishing private correspondence in the media or on the internet without the other party’s consent is prohibited.
