BAKU, Azerbaijan - A previously awarded disability labor pension may be reinstated if payments ended after the established disability period expired and no more than five years have passed, Azerbaijan’s State Social Protection Fund said.
The rule applies to disability labor pensions awarded because of a general illness. Article 33 of Azerbaijan’s Law on Labor Pensions states that such a pension is restored when no more than five years have passed since payments stopped because the disability period ended.
What Happens After Five Years
If a new disability is established more than five years after payments ended, the previous pension is not restored automatically. The applicant’s eligibility is reviewed again under the general rules.
A new disability labor pension is awarded if the applicant meets the legal requirements. If eligibility is not established, the fund issues a refusal and notifies the applicant through the communication channel provided in the application.
The fund said no time limit applies when a previously awarded disability pension is restored for other reasons.
How to Apply
Restoration and reassessment are handled electronically. If the service cannot be completed online, the applicant or an authorized representative may submit the required documents to the appropriate State Social Protection Fund office or a DOST center.
The service is available to Azerbaijani citizens, as well as foreign nationals and stateless people who permanently reside in the country. The fund reviews each application under the law and decides whether to restore the pension, award a new pension or refuse the request.
