Witnesses are not required for the state registration of marriage in Azerbaijan, according to information cited by APA TV from the country’s Justice Ministry.
The report says other people may attend the registration ceremony at the couple’s request, but having witnesses is not a compulsory legal condition for the marriage to be registered.
Under the rule cited in the report, if the bride and groom choose to include witnesses, the number of witnesses signing the marriage record cannot exceed two. The same report says Azerbaijani legislation does not set special restrictions on the witnesses’ age, family relationship to the couple, or other similar criteria.
The issue often causes confusion because many people assume a marriage cannot be registered without witnesses. But the legal explanation cited by APA TV indicates that their presence depends on the wishes of the couple rather than on a binding registration requirement.
The report also says that acting as a witness at a marriage registration does not create any separate legal responsibility or obligation for that person.
It’s also noted that the religious side of the issue can differ from the rules governing civil registration. In Islamic practice, the role of witnesses may vary depending on the school of thought, but for state marriage registration in Azerbaijan, witnesses are presented in the report as optional rather than mandatory.
