A person who has continuously and without dispute possessed unregistered real estate as its actual owner for 30 years may seek registration as the owner under Article 178.6 of Azerbaijan’s Civil Code.
The provision is examined in a Qafqazinfo report cited by Vesti Baku. The absence of property title extracts, commonly called kupcha, is a particular problem in Baku and Absheron. Some occupants hold documents insufficient for state registration, while others have no documents establishing ownership.
What the 30-Year Rule Means
The rule concerns property not entered in the state real estate register. To seek registration, the claimant must have possessed it continuously and without challenge for 30 years as an actual owner. The nature of possession matters, not simply how long someone has lived there.
The Civil Code provides the legal framework, but the report also addresses a dispute over when the 30-year period begins.
One approach encountered in practice counts only possession after the code took effect on Sept. 1, 2000. Under that interpretation, the provision could not be used until after September 2030.
The report challenges the need to wait, citing the constitutional principle that legal provisions improving the legal position of individuals and legal entities may have retroactive effect. On that basis, the author argues that possession before September 2000 can also be counted. That is the interpretation advanced in the publication, not an automatic guarantee of registration.
Separate Conditions for Unauthorized Buildings
Different conditions apply to buildings erected without authorization. Constructing a house does not by itself create an ownership right.
As the report explains, a court may recognize ownership of such a structure for a person who owns the land beneath it. Keeping the building must not infringe other people’s rights or create a threat to life and health.
Thirty years of possession of unregistered real estate and court recognition of ownership of an unauthorized building are separate legal grounds. Eligibility for a title extract depends on the property’s status, rights to the land and compliance with the applicable legal conditions.
