BAKU, Azerbaijan - A mortgage does not automatically disappear when a borrower dies. Insurance coverage, inheritance decisions and the terms of the loan contract determine what happens to the debt and the pledged home.
The remaining balance may be paid by an insurer if the death qualifies as a covered event. If no payment is made, heirs who accept the property may also inherit obligations connected with it, according to Vesti Baku.
Relatives do not become liable simply because of family ties. Their position depends on whether they accept the inheritance, whether they signed the loan as co-borrowers or guarantors, and what the credit and insurance contracts provide.
When Insurance May Pay
Mortgage arrangements generally include property insurance and life and disability coverage for the borrower. Azerbaijan’s Law on Mortgage provides that, where stipulated by the agreement, an individual debtor must obtain life and disability insurance for no less than the amount of the secured claim.
If the death is a covered event, the insurer may repay the outstanding balance within the policy limits. A policy does not guarantee payment in every circumstance, however. Covered risks, exclusions and the information disclosed when the contract was signed all matter.
Specialists cited in the report said disputes may arise over undisclosed chronic illnesses or a cause of death excluded from coverage. An illness alone does not automatically justify denial; the decision must be based on the policy’s terms and the facts of the claim.
Limits on Heirs’ Liability
Articles 1306.4 and 1306.5 of Azerbaijan’s Civil Code limit heirs’ responsibility to the value of assets received from the estate under specified conditions.
If a notary prepares an inventory of the inheritance, heirs are liable to the deceased’s creditors only up to the value of inherited assets. Without such an inventory, an heir must prove that the deceased’s debts exceed the inheritance to receive the same limitation, according to the law introducing those provisions.
A properly filed refusal of an inheritance means giving up both the property and obligations arising from the inheritance. It does not erase a person’s separate contractual liability if that person independently signed as a co-borrower.
Can the Apartment Be Sold?
If insurance does not pay and the loan is not serviced, the lender may pursue foreclosure and sale of the mortgaged apartment through the legally established procedure.
Sale proceeds are applied to the outstanding debt and permitted expenses. Any remainder goes to those legally entitled to it. The borrower’s death by itself does not automatically mean the family loses the home.
Families should promptly notify the bank and insurer, request the outstanding loan balance and the procedure for filing an insurance claim, and contact a notary about the estate. Waiting for an insurance decision does not replace the inheritance process.
