Adults Divorce. Why Does the Child Pay the Price?

After a divorce, a child still needs food, clothing and schooling. The child still needs care and safe contact with both parents. Yet money, visitation and housing too often become weapons adults use against one another.

“If you do not pay, you will not see the child.” “If you do not let me see the child, you will not get any money.” Something basic disappears behind those ultimatums: child support belongs to the child, and a relationship with a parent also matters to the child. The adults argue over who owes whom more while the child waits.

Divorce can be the right and necessary decision, especially when remaining together has become dangerous. But the end of a marriage should not become the beginning of a years-long war.

260 Manats Is Not a Ready-Made Answer for Every Family

Azerbaijan’s monthly subsistence minimum for children is 260 manats in 2026, or about 8.7 manats a day when divided by 30. That money must cover a wide range of a child’s needs. But 260 manats is not a uniform child-support award automatically imposed in every case. The figure is established by Azerbaijan’s 2026 subsistence-minimum law.

Under the general rule, when parents have no support agreement, a court may order one-quarter of income for one child, one-third for two children, and one-half for three or more children. The court may consider the family’s circumstances. When earnings are irregular or nonexistent, support may be set as a fixed sum. These rules appear in Article 76 of Azerbaijan’s Family Code.

That means saying “I do not have an official job” does not end the duty to support a child. At the same time, no one can simply demand any amount without regard to the actual circumstances.

What families need is a clear calculation: how much the child requires, what each parent can afford and which expenses each parent will cover.

Care itself is also work. Taking a child to school, staying home during an illness, finding a doctor and helping with homework all require time and effort. The parent with whom the child lives does that work every day. A bank transfer does not replace everything else.

Why Child Support Can Remain Unchanged for Years

Prices change and children grow, but support payments sometimes remain the same. It is important to distinguish between indexation and a court-ordered increase.

Azerbaijan’s Supreme Court has explained that indexation is tied to changes in the minimum wage. A change in the amount of child support, by contrast, depends on changes in the parties’ financial or family circumstances. An increase in the child subsistence minimum does not automatically raise every payment ordered in the past.

There is also an important detail for parents who settle matters amicably. If a court-approved agreement specifies a fixed amount but says nothing about indexation, the parties should not assume it will automatically increase. When circumstances justify a change, the issue may have to be addressed separately.

Before signing an agreement, parents should ask simple questions: When will the money arrive? How will the amount change? What happens after a late payment? Those details are more useful than agreeing to everything simply to end the dispute quickly.

A Child Should Not Wait Outside a Closed Door

For a parent who lives separately, contact with the child should not depend on a former spouse’s mood. Families need a clear schedule covering days, times, school holidays and phone or video calls.

Current judicial guidance allows courts to address contact arrangements during divorce proceedings. Contact may also be restricted when it harms a child’s health or development.

Both parts of that rule matter. A parent should not be erased from a child’s life without grounds. But a child should not be forced to endure violence or dangerous behavior in the name of preserving the appearance of a complete family.

Verified facts and the child’s interests must guide the decision.

Visitation rights also carry responsibilities. Being a parent means participating in the child’s life, knowing about the child’s health and education and understanding the child’s difficulties. Merely demanding, “Let me see my son or daughter,” is not enough.

The Name on the Apartment Deed Is Not the Entire Answer

After divorce, one spouse may say: “The apartment is registered in my name, so it is mine.” But property acquired during a marriage with joint income is generally considered marital property even when it is registered to only one spouse. The source of the money and the circumstances of the purchase matter.

The opposite assumption - that everything automatically became joint property after the wedding - is also wrong. There are exceptions, and every dispute requires a review of the documents.

Joint property is usually divided equally unless an agreement provides otherwise. A court may depart from equal shares in circumstances recognized by law, including consideration of children’s interests. But the fact that a child lives with one parent does not automatically give that parent the entire apartment.

Timing also matters. The three-year period for seeking division of property does not necessarily begin on the date of divorce. It can run from the time a person learned, or should have learned, that his or her rights were violated. Advice that “you divorced years ago, so you can no longer claim anything” may therefore be wrong.

Talk About Money Before the Conflict

A prenuptial agreement is still sometimes treated as a sign of distrust. In reality, discussing an apartment, savings and household expenses in advance is far calmer than dividing them after a painful separation.

But people must understand what they sign. No one should accept such an agreement after being told that it is “just a formality.”

A prenuptial agreement can regulate property matters, but it cannot prearrange rights concerning children or deprive a spouse of the right to go to court. The law also prohibits terms that leave one spouse in an extremely unfavorable position.

The position of a spouse who left paid employment to care for the family must also be considered. While one spouse earned wages, the other may have raised the children and managed the home. That does not mean the second spouse contributed nothing to the marriage.

Divorce alone does not make someone a bad father or a bad mother. What matters is what happens afterward: whether support arrives on time, whether agreements are honored and whether the child is kept out of adult resentments.

A child should not have to ask for money for a school uniform, choose between parents or fear that describing a happy day with one parent will hurt the other.

Spouses can stop being spouses. They cannot stop being parents.
