Renovated Home May Hide Demolition Risk, Azerbaijan Expert Warns

Must read

A fresh renovation and an attractive price can conceal a serious problem for homebuyers in Azerbaijan: drainage collectors, utility lines or other infrastructure may run beneath the property, creating registration and demolition risks.

Real estate expert Elnur Farzaliyev said buyers should determine why a house lacks an extract from the State Register of Immovable Property, commonly known as a “kupcha,” before paying for it.

His comments were made in a television report about homes built over collectors. The issue cannot normally be identified through a visual inspection of the renovation, walls or facade.

Check the House and the Land

Farzaliyev recommended checking the available documents for both the building and the land with the relevant state agencies, municipality and district executive authority.

Buyers should establish:

  • why the property has no state-register extract;
  • which documents exist for the house and land;
  • whether the designated use of the land permits the building;
  • whether collectors or other engineering networks run below the property; and
  • whether legal or planning restrictions prevent registration.

Azerbaijan’s State Service on Property Issues oversees the cadastre and registration system. A seller’s verbal assurance that documents will be issued later is not a substitute for an official check.

Some Document Problems Can Be Fixed, Others Cannot

Farzaliyev said buyers should distinguish between correctable paperwork deficiencies and restrictions caused by the property’s location. A missing document may sometimes be obtained after outstanding requirements are satisfied, but construction over engineering infrastructure can expose the building to demolition.

If a seller knew about a collector or another material defect and failed to disclose it, the buyer may have grounds to bring a claim. If the house is later demolished without compensation, the buyer may seek repayment from the seller in court.

Recovery is not automatic. A court would examine the transaction, the evidence and what each party knew when the sale was completed.

The practical lesson is to establish the property’s legal status and the location of underground infrastructure before transferring money. Renovation or additional investment cannot solve a fundamental restriction on where the house was built.
