Adult children in Azerbaijan may be required by court to cover additional expenses related to the care and support of elderly parents.
Lawyer Emil Aslanov told Demokrat.az that the participation of adult children in additional expenses connected with their parents is regulated by Article 83 of Azerbaijan’s Family Code.
According to him, this applies to cases where adult children do not financially support their disabled or incapacitated parents, while the parents suffer from a serious illness, have a disability, or need care provided by third parties.
“If there is a need to use the services of outside persons for the care of parents and to pay for those services, as well as in other exceptional circumstances, children may be required through court to cover the additional expenses arising from that situation,” Aslanov said.
The lawyer explained that the amount of such additional expenses and the payment procedure for each adult child are determined by the court.
In making its decision, the court takes into account the financial situation of both the parents and the children, family circumstances, social status and other factors relevant to the case. These issues are regulated in line with Articles 82.3-82.6 of the Family Code.
Aslanov added that the amount and procedure for covering such expenses may also be determined by mutual agreement between the parties, without going to court.
In this sense, care for elderly parents in Azerbaijan is not only a moral responsibility, but can also become a legal obligation. The law protects the right of disabled or incapacitated parents to financial support and care in difficult life circumstances.
