Azerbaijan may launch an amnesty program for homes without property documents, allowing hundreds of thousands of houses to be legalized in stages.
The proposal was made by MP Kamal Jafarov during a session of the Milli Majlis. According to him, there are currently more than 500,000 undocumented homes across the country.
Jafarov said the lack of ownership documents creates serious legal and social problems for residents. People living in such homes often cannot register their place of residence, which limits their access to state services in the area where they actually live.
In some cases, residents also face difficulties connecting their homes to the gas network. The problem becomes even more serious in family and inheritance matters.
According to the MP, if the head of a household dies, inheritance rights are not automatically recognized. The property also cannot easily be transferred to children through legal procedures, and in divorce cases, one of the parties may be unable to make a proper legal claim to the home.
Jafarov said undocumented homes are currently sold for 20-30% below their real market value and are not accepted by banks as collateral.
“Property rights are a fundamental issue,” he said.
The MP proposed declaring an amnesty for undocumented homes during the Year of Urban Planning and Architecture, preparing a special program, and resolving the issue gradually.
He added that the process should not apply to all properties without exception. Homes located in protected transport or energy zones, dangerous areas, strategic land plots, or properties involved in disputes could be excluded.
Jafarov said legalizing eligible homes could also create additional and sustainable value for the economy and the state budget, potentially amounting to millions of manats.
