Money accidentally transferred to the wrong bank card can be recovered, although the sender may need to go to court if the recipient refuses to return it.
Lawyer Amid Asgarov said the first step is to notify the bank immediately. The bank can then contact the recipient and explain that the transfer was made by mistake and should be returned.
If the recipient agrees, the issue can usually be resolved without further legal action.
The situation becomes more complicated when the recipient refuses to return the money. In that case, the sender may file a claim in court.
Banks generally cannot disclose the cardholder’s personal information directly to the sender because the data is protected by banking secrecy rules. A court request may therefore be required to obtain information about the recipient before a lawsuit can be filed.
Under Article 1091.1 of Azerbaijan’s Civil Code, a person who receives property or money at someone else’s expense without a legal basis is considered to have been unjustly enriched.
The recipient is required to return the money regardless of whether the amount has already been spent.
People who make an incorrect transfer are advised to contact their bank as quickly as possible and keep the transaction receipt and payment details. If the funds are not returned voluntarily, they may be recovered through legal proceedings.
