How to Obtain a Title Deed for an Undocumented Home in Azerbaijan

Must read

The absence of a title deed does not always mean a home in Azerbaijan cannot be legally registered. An old technical passport, a decision allocating the land or another previously issued document may provide a basis for registration.

Address registration and utility accounts in the occupant’s name, however, do not by themselves create ownership rights.

Real estate expert Elnur Farzaliyev identified two common reasons owners spend years trying to obtain an extract from the state property register: old documents cannot be confirmed in official archives, or the land was not designated for residential construction.

An unofficial estimate cited in the report puts the number of homes and other properties without registry extracts in Baku and the Absheron Peninsula at about 500,000.

When an Old Technical Passport May Help

Existing rules already provide a possible legal basis for some owners. Azerbaijan’s State Service on Property Issues says technical passports for residential and garden houses issued by technical-inventory authorities before Jan. 1, 2001, may be treated as title documents if they state the size of the adjoining land plot.

The rule was introduced by Presidential Decree No. 444 of July 16, 2025. It allows an owner with a qualifying old passport to seek registration, but it does not automatically cover every technical document regardless of its date or contents.

Land Records Still Matter

Farzaliyev said problems often arise when documents allocating land - including decisions once issued by collective farms, state farms, municipalities or executive authorities - cannot be verified in archives.

The land’s legal designation is another obstacle. If a house was built on land that was not intended for residential construction, the fact that people have lived there for years is not enough to establish ownership.

Owners therefore need to examine both the documents for the building and the legal basis for using the land. The required papers depend partly on when the property was built and which registration procedure applies.

Where an Owner Should Start

Farzaliyev recommends gathering every available document and submitting a formal application to the property-registration authority. The service is available through ASAN xidmət centers.

Applicants should provide any old technical passport, land-allocation decision and other records connected to the origin of their rights. The registration authority must then assess whether those documents have legal force.

Address registration and contracts for gas, electricity or water do not replace ownership documents. They may show that a person uses the home, but a utility account does not mean the property is registered to that customer.

If an application is rejected, the owner should determine the exact reason. The problem may involve the documents, the land’s status or legal requirements for the structure itself. An applicant may challenge a refusal in an administrative court, but litigation cannot create lawful grounds for registration where none exist.

How Much Registration Costs

ASAN xidmət lists a 50-manat state fee for an electronic extract covering an individual residential or garden house and a 75-manat fee for technical documents.

Additional service charges may apply. The final cost depends on the work required, the property’s size and location, and how quickly the service is requested.

The 50-manat charge is therefore the fee for the registry extract, not the total cost of documenting a home.
