Part of Child Support Payments in Azerbaijan May Be Transferred to a Child’s Bank Account

A parent paying child support in Azerbaijan may ask a court to order that part of the money be transferred directly to a bank account opened in the child’s name.

The mechanism may be used when the paying parent believes that the funds are not being spent on the child’s needs.

However, suspicions alone are not sufficient. The parent making the claim must provide evidence that the payments are being used for other purposes.

The court reviews the circumstances of each case and considers the child’s actual needs, including food, education, medical treatment, daily living expenses and development.

If the amount of child support exceeds the child’s current expenses, the court may decide that part of the money should be deposited into an account held in the child’s name.

The accumulated funds would remain available to the child after reaching the age of 18. The parent with whom the child lives would not have the authority to spend that portion of the money at their own discretion.

Azerbaijani legislation does not set a fixed amount or percentage of child support that must be transferred to a child’s account. Each case is considered individually, with the child’s best interests serving as the main factor in the court’s decision.

Legal experts say such disputes are not widespread in Azerbaijan. They stress that the purpose of the mechanism is not to favor either parent, but to provide stronger protection for money intended for the child.
