A Baku resident says an apartment he legally purchased for 363,000 manats ($213,500) was seized because of a private debt owed by its previous owner, according to Xəzər Xəbər.
Shahsuvar Ahmadov said he bought the apartment in a high-rise building on Fazail Bayramov Street in Baku’s Khatai district in 2024. The seller was identified as Gunduz Gozalov.
According to Ahmadov, the transaction was formally completed, the purchase price was paid and the property title was registered in his name. At the time of the sale, the apartment had no recorded debts, mortgage, lien or other encumbrance.
Ahmadov said he learned by chance about 18 months later that the property had been placed under court-ordered seizure.
“I applied to the Khatai District Court, and the seizure was lifted,” he said.
“It turned out that Gunduz Gozalov, who sold me the apartment, owed Eldar Rahimov approximately 70,000 manats. This was his personal obligation and had nothing to do with me. My private property should not have been seized because of it.”
The disputed debt amounted to roughly $41,200.
Ahmadov said the former owner later informed him that the debt had been fully repaid through the enforcement service. He was also reportedly given an official stamped document confirming that the payment had been completed.
Despite that, Ahmadov said Khatai District Court Judge Amina Abbasova announced a decision to cancel his property title. He added that the court had not uploaded its written and reasoned ruling to the electronic judicial system even 26 days after the decision was announced.
Without the written ruling, Ahmadov’s attorney, Panah Mammadov, cannot formally appeal the decision.
Ahmadov is seeking the complete removal of any restrictions on the apartment and full protection of his ownership rights.
Xəzər Xəbər contacted the Khatai District Court for comment. Court representatives requested a formal written inquiry and said a response would be provided after the case was reviewed.
