Azerbaijan Moves to Prevent One Apartment From Being Sold to Multiple Buyers

Azerbaijan plans to introduce a new legal mechanism designed to prevent the same apartment from being sold to several buyers.

The proposal was outlined by Zahid Oruj, chairman of the Azerbaijani parliament’s Human Rights Committee, during an extraordinary session of the Milli Majlis.

Lawmakers were discussing amendments to the Land Code, the Civil Code and several laws governing housing privatization, property registration, land cadastres and agricultural insurance.

Oruj said the draft legislation is intended to address legal, economic and social problems that date back to the Soviet period and expanded during the years of independence.

One of the main issues involves land plots and properties allocated through decisions by municipalities and local executive authorities but never fully entered into the state registration system.

He also pointed to continued abuses in the construction sector, including cases in which the same apartment was sold to multiple people.

Under the proposed changes, legal relations between a homebuyer and a construction company would be immediately recorded in a state information system through a special security notice.

The mechanism is intended to block additional obligations or repeat sales involving the same property.

Oruj said the scale of the problem is reflected in the prosecution of executives from more than 20 construction companies in recent years. A total of 5,250 people were officially recognized as victims in those cases.

“Such incidents are not only a problem for individual families. They damage confidence in the market, affect trust in state institutions and harm the reputation of responsible construction companies,” he said.

According to Oruj, the reform would strengthen protections for buyers, improve public trust in developers and support the construction sector, which accounts for 6.5% of Azerbaijan’s gross domestic product.

Another major change would reduce the period for state registration of property rights from 10 business days to one business day.

Officials expect the faster process to accelerate property sales, mortgage and banking transactions, while reducing delays and additional costs for buyers, businesses and investors.

According to official figures, Azerbaijan completed 364,136 state property registration transactions in 2025. More than 1,000 real estate transactions are registered across the country on an average day.
