Many employees prefer not to use all of their annual leave at once and instead take vacation days in several parts throughout the year. Azerbaijani labor rules allow this, but only under certain conditions, according to Baku TV.
Under the law, every employee is entitled to paid annual leave. The number of leave days may vary depending on work experience, working conditions and other factors.
Employees may split their annual leave into parts, but this must be done by mutual agreement between the employee and the employer.
The key requirement is that at least one part of the leave must be no shorter than 14 calendar days. The remaining days can be used before the end of the working year, before the end of the calendar year or added to the employee’s next annual leave.
Experts say the main condition is agreement between both sides. An employer may object if the requested leave schedule disrupts the work process, so the timing should be coordinated in advance.
Vacation pay is calculated based on the employee’s salary over the previous 12 months. The total amount is divided by 12 to determine the average monthly salary. That figure is then divided by 30.4 to calculate the daily vacation pay.
The daily amount is multiplied by the number of leave days the employee uses.
The calculation is also compared with the employee’s most recent salary. If the amount based on the latest salary is more favorable for the employee, that figure is applied.
In practice, this means annual leave can be divided into parts, but the process must follow the law and be agreed upon by both the employee and the employer.
If a dispute arises over the granting of leave or the calculation of vacation pay, employees may appeal to the State Labor Inspection Service.
