The Building Had 10 Floors, but She Was Sold an Apartment on the 11th

A woman in Baku says she paid 80,000 manats, about $47,000, for an apartment on the 11th floor of a residential building that was never constructed beyond 10 stories.

The case involves a development on Academician Hasan Aliyev Avenue in Baku’s Narimanov district.

Mehriban Hasanova said she purchased the apartment in 2022 after finding the listing online and contacting an intermediary. She was later taken to the head of the housing cooperative, who provided her with a contract and a certificate.

Hasanova said she paid 1,150 manats, about $676, per square meter, for a total of 80,000 manats.

Before signing the agreement, she reportedly asked to see the apartment. According to Hasanova, company representatives instead showed her a unit on the third floor and assured her that the planned apartment on the 11th floor would have the same layout.

“They told me there was no need to go upstairs and showed me the third floor. They said the 11th floor would be exactly the same. It later turned out that there was no 11th floor at all,” she said.

Hasanova said she subsequently learned that government authorities had halted construction in 2020 and had not approved the addition of any floors above the 10th.

Despite this, she claims the developer sold her an apartment on the unbuilt floor two years later.

“Not a single stone was laid above the 10th floor. Yet in 2022 they sold me an apartment on a floor that did not exist,” Hasanova said.

Four years after the purchase, she says she has received neither the apartment nor a refund.

The company named in the report, MM Park LLC, said it would not comment until the court proceedings between the parties are completed.
