A parent in Azerbaijan does not have to file for divorce before seeking child support.
Both parents remain legally responsible for supporting their minor children regardless of whether the marriage continues or the spouses live together.
Azerbaijani mother Shahlag Ahramanova said she independently covers her child’s food, clothing, education and other expenses because her husband does not provide financial assistance. According to Ahramanova, her husband also refuses to agree to a divorce.
She now intends to seek child support through the courts.
Divorce Is Not Required
Attorney Ramin Suleymanov said married couples may live separately and maintain separate households without formally ending their marriage.
If the child is effectively living with and being supported by one parent, that parent may file a claim seeking payments from the other spouse. A separate divorce claim is not required.
Under Azerbaijan’s Family Code, parents are obligated to support their minor children. Their marital status does not remove that responsibility.
If the parents cannot reach a voluntary agreement, the parent caring for the child may apply to a court for support.
How Child Support Is Calculated
When no agreement exists between the parents, child support is generally calculated as a share of the paying parent’s income:
- One child – one-quarter of the parent’s earnings and other income;
- Two children – one-third of the parent’s earnings and other income;
- Three or more children – one-half of the parent’s earnings and other income.
A court may adjust these amounts after considering the parents’ financial and family circumstances, the existence of other children and the interests of the child.
If the paying parent has irregular income, receives money in foreign currency or does not have officially documented earnings, the court may set a fixed monthly payment. It may also combine a fixed payment with a percentage of income.
260 Manats Is a Benchmark, Not an Automatic Payment
Azerbaijan set the official subsistence minimum for children in 2026 at 260 manats, or about $153, according to the country’s law on the subsistence minimum.
However, describing 260 manats as the mandatory minimum child-support payment in every case would be inaccurate. The final amount is determined by the court based on the child’s needs, the parents’ income and other relevant circumstances.
The child subsistence figure may serve as an important benchmark, particularly when the court establishes support as a fixed monthly amount.
Payments generally begin from the date the claim is filed. In certain circumstances, a parent may seek unpaid support for a previous period of up to three years.
To obtain retroactive payments, the claimant must show that previous attempts were made to secure financial support and that the other parent avoided providing it.
Can One Spouse Claim Support for Themselves?
Azerbaijani law also allows a person to seek support from a spouse without ending the marriage, but only in specific circumstances.
A claim may be filed by:
- A spouse who is unable to work and requires financial assistance;
- A wife during pregnancy and for three years after the birth of the couple’s child;
- A spouse who requires assistance while caring for their shared child with a disability.
The other spouse must have sufficient financial resources to provide such support.
Claims that a husband prevented his wife from working, obstructed her career or treated her harshly are not, by themselves, listed in the Family Code as independent grounds for spousal support. A court must determine whether the claimant falls within one of the categories established by law.
A spouse’s refusal to divorce therefore cannot prevent the other parent from protecting the child’s financial interests. Child support may be claimed while the marriage remains legally valid.
