Baku woman says she bought apartment on 12th floor of 11-story building

A Baku resident says she bought an apartment on the 12th floor of a building that was ultimately built only up to 11 floors, according to Oxu.Az.

Amalya Adil Babayeva said she purchased the apartment from MM Park LLC in 2021.

According to Babayeva, the project initially called for an 18-story residential building on Hasan Aliyev Street, in Baku’s 945th block. Under the contract, she said, she was supposed to receive a 136.2-square-meter apartment on the 12th floor.

“After some time, it became clear that the building had 11 floors and construction would not continue above that level,” Babayeva said. “We contacted the company’s director, Shahlar Gurbanov. It turned out that the State Committee for Urban Planning and Architecture had canceled the construction documents in 2020 and halted the construction.”

Babayeva claims the company repeatedly promised that the upper floors would be built within two months. Later, she said, Gurbanov offered her an apartment of the same size on the 11th floor and said the roof would soon be installed.

“He said the roof would be completed soon and we would be able to move in,” she said. “But six years have passed and the roof still has not been closed. As a result, we can neither receive our apartment properly nor repair it and move in. How can we move into an apartment without a roof?”

Oxu.Az contacted Shahlar Gurbanov, director of MM Park LLC, who said he was aware of the matter and that the complaint had also been reviewed by law enforcement agencies.

Gurbanov said the building was originally planned as an 18-story project and that the relevant design and documents existed. He said construction was stopped by the State Committee for Urban Planning and Architecture after the 11th floor in 2020.

“We invited the complainant and informed her about the situation,” Gurbanov said. “The family agreed with us through a notarial procedure, and we exchanged her apartment for one of the same size on the 11th floor. Amalya khanum and her husband gave us notarial consent.”

Gurbanov said the resident can repair the apartment and move in at any time.

“The citizen’s apartment is covered from above and there is no dangerous situation,” he said. “The State Committee for Urban Planning and Architecture has not allowed us to complete the roof, so the work is temporarily suspended. But there is no obstacle to the citizen repairing the apartment and living there.”

Gurbanov also said he had challenged the committee’s decision in court after the construction was halted.

According to him, the case reached the Supreme Court, and in 2023 the court issued a separate ruling canceling the State Committee’s order.
