Azerbaijan’s Constitutional Court Seeks Stronger Protections in Criminal Cases

Must read

Azerbaijan’s Constitutional Court has recommended that parliament establish clear procedures for determining and restoring a person’s legal capacity in criminal proceedings and create support mechanisms for victims who cannot independently exercise their rights because of health conditions.

The court’s plenary issued the decision in response to a request from the Prosecutor General’s Office. The ruling takes effect on the date of publication and is final, but the referral to the Milli Majlis is a recommendation for legislative changes rather than an already-adopted amendment.

How Incapacity Must Be Established

The court interpreted Article 100.2.1 of the Code of Criminal Procedure.

It said a participant’s incapacity in criminal proceedings must be confirmed by a final court decision issued on the grounds and under the procedures established by civil law.

Such a decision would provide the basis for appointing a legal representative for a victim, civil plaintiff, suspect, defendant or civil respondent, unless a court later restores the person’s legal capacity.

Recommended Legislative Changes

The court recommended that legislation define the procedural rules for declaring a person incapable of participating independently in a criminal case and for subsequently restoring that capacity.

Although Article 100.3 of the criminal procedure code already provides relevant authority, the Constitutional Court said a clearer process is needed.

The court also called for separate support mechanisms for victims whose health conditions do not meet the threshold for a formal incapacity finding but still prevent them from exercising their procedural rights and duties independently.

The purpose would be to ensure their effective participation in investigative and court proceedings and access to protections guaranteed by law.

The decision cited constitutional guarantees of rights and freedoms, judicial protection and compensation for harm. Parliament will determine the specific forms of support and how they should be applied.
