Azerbaijan Rent-to-Own Rules Set Three-Year Transfer Waiting Period

Must read

An active mortgage financed by Azerbaijan’s Mortgage and Credit Guarantee Fund blocks access to the fund’s rent-to-own housing program, while new contracts now carry a longer waiting period before obligations may be transferred to another person.

The changes have applied since Oct. 1, 2026, according to the fund’s explanation.

Three Years Before Transfer, Five Before Reapplying

A participant may transfer obligations under a rent-to-own agreement to another person after three years have passed from the date of the contract.

A person who uses that option may return to the program only after five years. The five-year period is measured from the transfer of the obligations, not from the date of the original agreement.

Anar Jabrayilli, head of the fund’s communications and information-support service, told Pravda.az that the three-year rule applies to agreements signed after Oct. 1, 2026. Earlier contracts retain the previous general 12-month waiting period, he said.

Who Cannot Use the Program

An applicant may not have an active mortgage financed by the fund at the time of application. The applicant’s credit history must also receive a “positive” or “satisfactory” assessment.

These conditions apply to the state rent-to-own program. They do not prohibit people with mortgages from renting housing in the ordinary market and do not apply to every commercial mortgage product.

The fund said the changes are intended to expand access for people who need housing and prevent abuse. Individual questions may be directed to its 1549 call center.
