A homeowner in Baku’s Nizami district has rejected compensation offered by a construction company, arguing that the calculation covers only the registered area of his house while excluding the yard, garage, gazebo and additional rooms.
The dispute concerns a property at 12 Ali Fajiyev Street. Owner Nureddin Bagirov said Orbita MTK, a housing construction cooperative, refused to include the surrounding yard in its compensation calculation.
“The company says the yard, gazebo and other structures are not relevant. It will consider only the area listed in the property documents and add another 10 to 20 square meters,” Bagirov said.
According to the homeowner, the property originally had three rooms. Two additional rooms and a balcony were later added, but those extensions do not have extracts from the state property register.
Bagirov said he purchased the home for 33,000 manats, or approximately $19,400, at a time when comparable three-room houses were selling for 17,000 to 19,000 manats, roughly $10,000 to $11,200.
He said he agreed to pay the higher price because the property included additional rooms, a private yard and a garage beneath the house.
The homeowner is demanding two separate three-room apartments in exchange for vacating the property.
Developer Offers Nearly Double the Registered Area
Orbita MTK representative Fazil Bagirov presented a different account of the dispute. He said the house’s officially registered area is 62.5 square meters.
According to the company, the owner was offered two apartments with a combined area of 121.8 square meters – almost twice the area recorded in the official property documents.
“We offered him two apartments totaling 121.8 square meters. He refused and demanded two three-room apartments. The dispute has therefore gone to court,” the company representative said.
Addressing the status of the yard, he said the homeowner possesses a municipal document but does not have an extract confirming state registration of the land and additional structures.
The company reportedly asked the owner to apply to the relevant state property authority and obtain the necessary extract. Orbita MTK said it would reconsider his demands if the additional area were officially registered.
The two sides failed to reach an agreement. The amount of compensation and the future of the property will now depend on the court’s decision.
