In Azerbaijan, a Husband May Be Denied a Divorce

A court in Azerbaijan may refuse to accept or may return a divorce petition if it does not meet procedural requirements.

The law also directly restricts a husband’s right to seek a divorce during his wife’s pregnancy and for one year after the birth of a child.

Lawyer Elnur Mammadov told Demokrat.az that while every person has the right to apply to a court to dissolve a marriage, the claim must comply with Azerbaijan’s Civil Procedure Code and be submitted to the court with proper jurisdiction.

According to the lawyer, a divorce petition may be returned if it does not meet the legally required form and content or if the applicant fails to attach the necessary documents.

A court may also return the claim if the case falls outside its jurisdiction, the application was signed by an unauthorized person, or another case involving the same parties, subject and legal grounds is already pending.

A separate restriction is established under Article 15 of Azerbaijan’s Family Code.

“During the wife’s pregnancy and for one year after the birth of the child, the husband may not file for divorce without his wife’s consent,” Mammadov said.

The restriction applies specifically to a divorce initiated by the husband without the woman’s consent.

To have a divorce case accepted, applicants must therefore prepare the documents correctly, follow jurisdiction rules and take into account the limitations established by law. Otherwise, the court may leave the application without action, return it to the claimant or decline to accept it for consideration.
