Can a Resident Be Removed From a Sold Home Without Their Consent?

A person registered at a home in Azerbaijan may retain certain residential rights even after the property is sold, particularly when the house does not have an official title deed, or kupcha, a lawyer has warned.

Attorney Kenan Mammadov said registration at an undocumented property does not give a resident ownership rights. However, it may establish the address as the person’s official place of residence and provide a legal basis for using the home.

Registration may also allow residents to access local public services, including schools, kindergartens and other social programs tied to their place of residence.

At the same time, a registered resident cannot sell, donate or mortgage the property solely because they are registered there.

“If a house has no title deed and is not recorded in the state property register, the resident does not acquire the right to dispose of it as an owner,” Mammadov said.

The legal situation becomes more complicated when the property is sold and a registered resident refuses to leave or be removed from the address.

According to the lawyer, whether that person can be deregistered without consent depends on how the home was acquired, built or transferred, as well as the legal grounds on which the resident was registered.

For example, if a house was built jointly by a married couple during their marriage and both spouses are registered there, their rights may be considered equal. Different rules may apply if the property was inherited, informally transferred by relatives or remains state-owned and has not been privatized.

Mammadov said each dispute must therefore be reviewed individually. When the parties cannot reach an agreement, the issue of removing a registered resident may have to be decided by a court.

Buyers of homes without title deeds are advised to check not only the available property documents but also who is officially registered and actually living at the address before completing the purchase.
