Bought a Car, Then Found Hidden Defects: What Buyers Can Do

Complaints over used car sales are rising in Azerbaijan as buyers report serious technical problems that appear only after the deal is completed.

In some cases, motorists say engine, transmission or other major defects were discovered shortly after purchase. The disputes often center on whether the seller gave accurate information about the vehicle’s real condition or deliberately hid problems before the sale.

Lawyer Mushfig Abbasov told Demokrat.az that even after a car sale is formally registered, a buyer may still have legal grounds to challenge the deal if there is evidence of deception.

“The key issue is whether accurate information was provided to the buyer when the contract was signed,” Abbasov said.

He said a legal dispute may arise if the buyer later discovers that important facts were concealed, such as a replaced engine or a serious technical defect that existed before the sale.

“If this information was deliberately withheld from the buyer, it may create legal responsibility,” Abbasov said.

In such cases, the buyer can take the matter to court and seek to have the purchase contract declared invalid. The buyer may also demand the return of the money paid for the vehicle.

If the seller refuses to cancel the deal voluntarily, the case must be resolved through the courts.

Abbasov said evidence is critical in such disputes. Technical inspection records, service documents, diagnostic reports and expert opinions can all become important proof that the defect existed before the sale or was hidden from the buyer.

The issue can also be settled without a lawsuit if both sides agree. In that case, the contract may be canceled by mutual consent and the buyer’s money returned.

Lawyers advise buyers in Azerbaijan not to rely only on the seller’s words or a quick visual inspection. Before purchasing a used car, buyers should have the vehicle checked by specialists, read the contract carefully and document the car’s technical condition wherever possible.

Otherwise, a deal that looked attractive at first may turn into a costly legal dispute.
