Cheap Cars Can Cost Buyers Dearly: Lawyer Warns Of Legal Risks

Buyers in Azerbaijan are being warned not to rush into purchasing cars offered at suspiciously low prices without checking the vehicle’s documents and legal status.

As the number of car sale transactions has increased in recent years, legal disputes have also become more common. These include forged documents, vehicles under pledge or seizure, disputes over powers of attorney and problems with formal ownership registration.

Lawyer Rashad Aliyev told Demokrat.az that one of the most common risks in car purchases is the failure to fully check the legal status of the vehicle before signing an agreement.

“In practice, there are cases where a car is pledged, seized or subject to other obligations. Buyers who sign contracts without carefully checking the documents may later face disputes,” he said.

Another widespread problem involves cars sold through a power of attorney. Aliyev stressed that a power of attorney does not transfer ownership rights. In such cases, problems may arise later involving the actual owner of the vehicle.

He said car sale transactions must be formalized in accordance with the law.

The lawyer also noted that some sellers hide information about the technical condition of a car or its accident history. If serious defects are discovered after the purchase, the dispute may end up in court.

If the seller deliberately concealed the defects, the buyer may demand cancellation of the contract or compensation for damages.

Aliyev said other common problems include discrepancies between the actual owner and the person listed in the documents, forged paperwork, unpaid fines and tax debts.

Some citizens also complete car purchases without a notarized contract or fail to keep documents confirming payment. This makes it much harder to defend their rights later if a dispute arises.

The lawyer advised buyers to check the legal status of the vehicle, formalize the purchase officially, document all payments and seek legal advice when necessary.

He warned that buyers should be especially cautious with offers that appear too cheap. A low price may hide major legal problems.

Experts say failure to check documents and properly register a transaction can leave a buyer without money, without the car and facing lengthy court proceedings.
