If a Crime Happens in a Rental Apartment in Azerbaijan, Is the Landlord Responsible?

Crimes committed in rental apartments often raise a legal question in Azerbaijan: can the owner of the property be held responsible simply because the incident happened in his or her apartment?

The issue is especially sensitive when the case involves a serious crime, fraud, illegal drug circulation or another unlawful act. Many people assume that if something happens inside a rented apartment, the landlord may automatically face legal consequences.

Lawyers say the matter is regulated differently under Azerbaijani law.

Attorney Emil Aslanov told local media that the key question is who committed the crime and whether that person’s guilt has been proven.

According to him, Azerbaijan’s Criminal Code is based on the principle of liability for guilt. Article 7 of the Criminal Code states that only a person whose guilt has been established for committing a socially dangerous act and its consequences can be held criminally liable and punished.

This means that, as a general rule, a person cannot be prosecuted simply because he or she owns the property where a crime took place.

The same principle applies to rental relations. If a tenant commits an illegal act inside a rented apartment, responsibility falls directly on the person who committed the offense.

“The fact that a crime took place in a rented apartment does not automatically mean that the landlord is responsible,” Aslanov said. “Criminal responsibility belongs to the specific person who committed the act and whose guilt has been proven.”

The lawyer noted that a landlord may face separate legal consequences if the apartment was rented out without a formal agreement or if tax obligations were not fulfilled. However, those issues are assessed separately and are not automatically linked to the crime itself.

In other words, failure to sign a rental contract or pay taxes may lead to administrative or other legal responsibility, but it does not by itself create criminal liability for the landlord.

Aslanov also said that there are sometimes misconceptions about the possible responsibility of real estate agents. Under Azerbaijani law, neither a landlord nor a realtor can be held criminally liable only for renting out a property.

Legal responsibility in criminal cases is determined on the basis of guilt, the lawyer said. Investigators establish who committed the crime, who suffered harm and whether any other people were involved.

The lawyer added that rental relations should still be formalized properly. A written lease agreement helps protect both landlords and tenants and may prevent future disputes.

The main point, he said, is that if a crime occurs in a rental apartment, the person who committed the crime is responsible – not automatically the owner of the property.
