In Azerbaijan, A Spouse May Seek Up To 10,000 Manats Over Adultery

Adultery in Azerbaijan may no longer remain only a private family matter. In some cases, it can become the basis for a lawsuit seeking compensation for moral harm.

Lawyer Elmar Suleymanov told Media.Az that Azerbaijani law does not directly punish marital infidelity as a separate offense. There is no automatic legal obligation to pay compensation simply because one spouse was unfaithful.

But the situation changes if the affair caused humiliation, public reputational damage or serious psychological suffering. In such cases, the injured spouse may try to claim moral compensation through the courts.

The amount is decided by the court based on the circumstances of the case. Judges may consider the level of emotional suffering, the behavior of both sides, whether the matter became public and the financial position of those involved.

According to Suleymanov, Azerbaijani courts usually take a moderate approach. In practice, moral compensation in such cases is often considered within a range of about 2,000 to 10,000 manats.

The key issue is evidence. Messages on WhatsApp or Telegram, photographs, videos and audio recordings may be submitted in court, but only if they are authentic and obtained legally.

That is where many cases become risky. Unauthorized access to a spouse’s private messages, spyware, secret recordings or hidden filming in private spaces may be rejected by the court. Such methods can also create legal problems for the person trying to prove the affair.

In other words, Azerbaijani law does not punish adultery itself. But it may allow compensation when betrayal leads to proven moral harm. The court will look not only at what happened, but also at how it was proved.
